Request for approval of the zoning of 1655 Lewisburg Pike. <\/p>\n

Town Attorney Mills noted that the Town passed by resolution the annexation of this property, which was outside the Town's Urban Growth Boundary, by referendum in September 2012.  Late last year, it was discovered that the Town had never administratively completed that annexation process.  The referendum was held, and the results were certified by the Williamson County Election Commission, but the Town never sent the appropriate notices to the State of Tennessee and Williamson County.  This has been corrected, and the property has been fully annexed, and requires an initial zoning, which should have happened 14 years ago.  The Town is requesting a recommendation on to the Board of Mayor and Aldermen for the initial zoning of this property to the CC, Community Commercial, zoning district.  The properties to the south and west that are in the Town limits are also zoned CC.  This is along the Lewisburg Pike\/Highway31 corridor.<\/p>\n

Chair Rumpler called for a motion; Commissioner Stephenson made a motion to make a favorable recommendation to BOMA for the zoning of this property to Community Commercial; Commissioner Harris seconded the motion; Town Attorney Mills stated that the property owner was present for any questions; a discussion ensued.<\/strong><\/p>\n

Discussion included the question if there was any reason that the CC zoning would not be appropriate for this property.  Town Attorney Mills stated that this is in the General Plan, it is along the Highway 31 corridor, and the surrounding properties are zoned CC.  Also, the applicant stated that she was seeking the CC zoning 14 years ago and the Town felt it was the right thing to rectify this issue and bring this into full compliance.<\/strong><\/p>\n

Staff noted that this is a 12-acre site in the T3 Neighborhood Mixed-Use zoning district.  This site is located at the intersection of Carters Creek Pike and Thompson's Station Road, West.  This Site Plan shows access to the site off Thompson's Station Road, West, and right-of-way dedication for future sidewalks along both Thompson's Station Road, West and Carters Creek Pike is provided.  Staff recommends approval of the Site Plan including contingencies as listed in the Staff Report.  The applicant was present for questions.<\/p>\n

Commissioner Harris made a motion to approve the Site Plan to include all Staff contingencies; Commissioner Stephenson seconded the motion; a discussion ensued.<\/strong><\/p>\n

Discussion included a question asking for clarification on whether the contingency regarding the sprinkler system, due to a concern with the water flow at this site, would be approved separately.  Staff stated that this would be included in the contingencies listed in the report; however, it could be removed.  Staff noted that this site does have low water flow and Staff is working with the applicant on these issues, and is in discussion with Williamson County also.  Staff also noted that the LDO does allow the Planning Commission to grant relief for the 1,500 gallon per minute flow at the street by providing fire sprinklers throughout the entire building, and the County has stated that is their choice.<\/strong><\/p>\n

Staff noted that this site is 46.66 acres, and is proposed to have five buildable commercial\/retail lots with three accesses from Columbia Pike connecting to one main internal road. This site is zoned Community Commercial.  A site plan for each parcel will be presented to the Planning Commission for approval prior to individual site approval. Lots 1, 2, and 3 along Columbia Pike will not have direct vehicular access from Columbia Pike.  Staff provided an overview to the PC of the LDO regulations regarding Preliminary Plat submittals, reviews, and approvals.  Staff recommends approval of the Preliminary Plat to include contingencies as listed in the Staff Report.  The applicant was present for questions.<\/p>\n

Discussion included questions and concerns regarding traffic issues in general, access points, and offsite improvements including three additional traffic lights between I-840 and Critz Lane.  Staff stated that the Transportation Impact Study warrants three traffic signals; however, the Town and TDOT have spacing requirements and there is to be a meeting scheduled with TDOT and the developer for discussion on this issue. Town Engineer Owen stated that with a high level of certainty he believes there will be only one traffic signal and it is undetermined which of the three, but it is highly anticipated it will be the middle traffic signal due to the spacing requirements.  The applicant answered some questions regarding the access points, which are still pending discussion with TDOT, and information in the TIS regarding the amount of traffic exiting from I-840.  The applicant stated that there will be significantly more traffic; however, the traffic study includes recommendation for a signal study along the Columbia Pike corridor and optimization of existing signals.  Town Engineer Owen stated that the new transportation guidelines are targeted mainly for platting of residential subdivisions and commercial sites.  He also stated that this submittal does not give any rights or vesting to any specific user, store, restaurant, etc., and is only for the purpose of subdividing this land that is already zoned Community Commercial.  He also gave an overview of a note on the plat which explains that the number of connections points, and signalization of these, are dependent on Town and TDOT reviews and approvals at the time Site Plans are submitted and may differ from what is shown on this Preliminary Plat.  Town Attorney Mills confirmed that there will be a Final Plat and five Site Plans reviewed by staff and the Planning Commission in the future, and that the final traffic studies will be tied to the site plans.  He stated that this is a non-discretionary act, and Staff is recommending approval based on the submittal meeting all requirements of the LDO, and if the Planning Commission disapproves, they will  need to state the reasons.<\/strong><\/p>\n

Item a. is being removed from the Bond Action Agenda.  This is for the Thompson's Station Hardware, Bedford Farms Commercial RDEC Bond Release.  The Thompson's Station Hardware commercial site is currently under construction at the intersection of Lewisburg Pike and Harpeth-Peytonsville Road.  This bond was posted as part of the proposed improvements located within the future right-of-way of Nita Drive.  Upon it's completion, Nita Drive will be a public Town street within the dedicated public right-of-way.  The request to release this bond is not recommended by Town Staff at this time.  As previously communicated to the applicant, the Letter of Credit for Bedford Farms should not be released until one of the following conditions occurs:  the access drive and connection to Lewisburg Pike, as shown on the Town approved site plan for Bedford Farms commercial site plan, is construction and approved by the Town, or a surety instrument is submitted to the Town on behalf of the Pleasant Creek development team, or owner, in conjunction with the Final Plat submitted that includes the area of Nita Drive from the Bedford Farms access drive to Lewisburg Pike.  The timeline for this condition to occur is not controlled by the Town, and therefore can't be estimated by Town Staff.<\/p>\n

Alderman White made a motion to reject the request to release the Letter of Credit, given the failure of the applicant to meet either of the conditions articulated in the Staff report; Vice-Chair Cagle seconded the motion; a discussion ensued.<\/strong><\/p>\n
