Planning Director Brad Baumgartner made an announcement to remind the Planning Commission of the email he sent with the video taping of the recent webinar training that some of the Commissioners attended, as well as staff, pertaining to the new State Law 1044 to take effect in January of 2027. Mr. Baumgartner explained that the information would be beneficial for Planning Commissioners to understand with the complexity of the changes and stated that it could serve towards their 4 hours of training requirement while also reminding them to log their hours accordingly. Chairman Serafino commented as to how he also felt there was a great benefit for the Commissioners to utilize the resource with the new law taking effect soon and asked that Mr. Baumgartner send the email out again to the Commissioners.

Eric Olsen of Anderson, Delk, Epps & Associates, Inc. was present on behalf of the property owner and available for questions.

The Town Planner, Adam Ray, introduced this item and informed the Planning Commission that he found an error noted on the Staff Report based on the applicant's submittal information. The Staff Report provided for the Planning Commission indicated that the acreage was 9.22 acres instead of the actual lot acreage which is 19.22 acres. Mr. Ray stated that the Staff Report would be corrected for Public Record given the circumstances.

The Town Planner, Adam Ray read the staff report indicating the parcel was currently CD-2L, but the applicant was requesting CD-4 and stated that Staff was recommending approval as noted.

Chairman Serafino asked for some specifics on the request as to what the applicant wanted to do and if they provided a concept plan. Mr. Ray explained that the applicant had provided a concept plan as one of the checklist items but that it was non-binding and that they had intended to build 21 Townhomes.

Eric Olsen explained for the Commission that the purpose of the rezoning request was to build a continuation of Green Brook North by building similar type townhomes which included a Right of Way dedication.

Chariman Serafino stated that he would entertain a motion.

Commissioner Adams stated that for discussion he would move for approval with staff recommendations with a second from Chairman Serafino.

Discussion was opened and questions presented regarding the Townhomes sitting in a floodplain and how the water would be pushed if they were to build the Townhomes. Mr. Olsen explained that they intended to have additional fill raising the Townhomes above the flood elevation.

Commissioner Adams referenced the fact that for CD-4 because the property is greater than 10 acres, only 85% of the structures could be residential, that 15% would have to be non-residential according to the current Zoning Ordinance.

Mr. Olsen stated that they only wanted to have residential units on the parcel but would be willing to break off some of the parcel and dedicate it to the Town.

Commissioner Adams stated that he would like to amend his motion given the concerns that presented and either table the request or state that it remain as CD- 2L indicating that given what the applicant is wanting, being to utilize a small piece of the parcel for Townhomes only that it would be in their best interest to have the Commission defer the request or they should withdraw their request and come back again now that they were informed of the requirement with 15% of the parcel needing to be non-residential.

Chairman Serafino asked Commissioner Adams, for clarification, from what you're saying it sounds like you are wanting to withdraw your motion not amend it, is that correct? Commissioner Adams stated that yes, he would like to withdraw his motion.

Chairman Serafino then made a motion for discussion purposes to approve the request with staff comments. There was not a second, so the motion failed.

Chairman Serafino asked the Town's legal Counsel, Charles Michels, for clarification, asking if without there being a second to the motion if that meant that the applicant would still move on with a negative recommendation to the Board of Commissions. Mr. Michels explained that yes that was what would happen next.

Vice Chair Gray stated that he was seconding the Chairman's motion to allow for further discussion.

Commissioner Adams also asked Mr. Michels if the applicant could come back anytime and Mr. Michels explained that they were not being denied as a decision was not being made by the Planning Commission but rather, they were simply recommending to the Board of Commissions either favorably or unfavorably.

Chairman Serafino stated that it didn't matter at this time anyway since another motion was on the table for discussion.

During this discussion, Commissioner Huber stated her concerns with the congestion already at the parcels intersection with there being a school and baseball fields close by. She also asked about the timeline for the project with regards to the sewer upgrades and if the Townhomes in Greenbrook North were already all spoken for.

Chairman Serafino asked staff to confirm that a rezone to CD-4 would be required for the applicant to build 21 townhomes on the parcel. Staff confirmed. Chairman Serafino further stated and confirmed that a deferment or postponement wouldn't change anything so the Commission should move forward with either a positive or negative recommendation at this time with the Board of Commissioners having the final say.

Vice Chair Gray asked for some clarification on Commissioner Adams comment about the percentages on the total parcel because he felt like there was a lot of variables happening with the applicant offering to donate land to the Town, which was not within the Planning Commissions scope to comment on or to make a decision for.

Commissier Adams asked staff to pull up the chart in the Zoning Ordinance to show the applicant the 15% requirement for non-residential with the intent to help the applicant understand the requirement suggesting that if they only wanted to use a portion of the parcel to build 21 Townhomes they may want to come back with another proposal where the request is for a parcel under 10 acres. Chariman Serafino asked the applicant what they would like to do given the circumstances.

Mr. Olsen asked if they could be granted an approval with a conditional variance for residential. Mr. Baumgarter, the Planning Director, stated to the applicant that they would have to go before the Board of Zoning Appeals to ask for a variance of the Zoning Ordinance. Mr. Olsen turned to the property owner asking him if he would like to defer the meeting.

Commissoner Stephenson addressed Mr. Olsen asking if he would like to know where the Commission stood before requesting the deferment. Chairman Serafino stated that by making a postponement there is no recommendation to the Board of Commissioners.

Commissioner Manley stated that he felt the Commission should still give the applicant an answer to their position on whether they felt that a rezone of the parcel to CD-4 was appropriate further stating that for him the answer would be a "no".

Chariman Serafino agreed stating that since there was a motion on the floor that he felt the best thing to do was to call a vote if there was no further discussion asking that all those in favor of approving the request for rezoning with staff comments as a recommendation to the Board of Commissioners signify by saying aye. There was no response from the Commissioners in approval of the request. Chairman Serafino then asked for all those opposed with a response from all as nay.

During the voting Mr. Olson stated that they would like to defer until next month's meeting, however, Chairman Serafino stated that he had already called the question in vote which did not allow for the deferment.

With all of the Commissioners opposing the request through voting, the request resulted in an unfavorable recommendation for consideration to the Board of Commissioners.

The Planning Director, Brad Baumgartner, led the Discussion by first asking if there was anything else from any of the other Articles that the Commissioner may want to touch on before moving into Article 8 which would be the primary focus for this meeting.

Commissioner Stephenson asked about Commissioner Adams comment regarding CD-4 regarding the retail requirement as he was looking at the noted revisions for the Zoning Ordinance provided with the Agenda packet stating that he did not see anything referencing that now and wondered if it was missed or moved looking for further clarification. Mr. Baumgartner stated that he wasn't sure where it was off the top of his head, but the idea was that districts would be in Article 4. He mentioned that given what came up it was important to also mention how the definition of development parcel has been challenging throughout the entire Zoning Ordinance since a development parcel is currently defined as 10 or more acres with a road through it and that within each district of a development parcel there shall be a mix so that might be something everyone needs to think about and give extra attention to.

Vice Chair Gray mentioned that he was still concerned about the Article on Signs regarding signs and glass coverage whereby he felt that there needed to be some limitation to the overall glass front noted so there is a limitation on both the window and the total aggregate. Mr. Gray also mentioned that he felt lighting should be addressed during hours of operation and that sign colors should be determined. The subject also came up of who handles the enforcement of these types of violations. Mr. Gray felt that further adjustments needed to be made to the Article regarding signs and stated that he would send an email to Mr. Baumgartner with some suggestions for revisions that the Commissioners could review for potential implementation into the new Zoning Ordinance.

The Planning Director, Brad Baumgartner, led the discussion on Article 8 explaining that essentially the Article consisted of procedures and processes in addition to who the players were and the approval bodies for each procedure. Mr. Baumgartner went on to say that things like pre-application review requirements and public notice requirements were also addressed in this Article and that given the content the entire Article would likely not be reviewed that evening.

Commissioner Adams asked if it was necessary to have a design review committee per se since the Town is now using a third party for design review.

Commissioner Adams also asked about the Development Review Committee stating that he felt it was more a "team" than a committee and suggested that it be called such given it consisted of in-house staff whereby a committee usually refers to people from the community.

Commissioner Adams also asked about what "D" "A" and "R" referred to on page 20 for clarification. Mr. Baumgartner explained that those comments were removed but referenced who the decision makers were, who to appeal to.

Commissioner Adams asked why non-profits were removed from the fee schedule as being exempt. Mr. Baumgartner stated that it was because the Towns cost still existed.

Commissioner Adams also asked about Public Notice to make sure that for rezoning requests the notices continued to be mailed to adjacent property owners particularly for the urban growth area where there were older residents that had properties that may not be able to pull off on the side of the road to look at a zoning sign.

Commissioner Huber asked if Public Notice could be posted on social media.

Mr. Baumgartner continued with the discussion explaining that one change he was proposing was to add to the Zoning Ordinance a Modification of Standards which would allow for a little bit of flexibility for developers but with control since the modification would go to the Board of Commissioners, without having to return to PUDS. The process would be that each modification would have to be requested and voted on separately by the Board of Commissioners. Mr. Baumgartner provided the language for the Modification of Standards for the Planning Commissions review and questions asking for feedback as to what they felt would be appropriate standards that a modification could be requested on versus not with a few standards noted as examples. The proposal had 5 items noted A-E that would qualify a request considered a modification acting as guardrails along with a list of standards where a request could not be granted.

Concerns were addressed by the Commissioners regarding the word "Minor" as referenced in the Modification of Standards proposal because the word minor could be interpreted in many ways without it being clearly defined.

The Commissioners also commented on their role as noted in the proposal being it stated that they would make recommendations to the Board of Commissioners regarding whether the modification of standard would be detrimental to public safety, health, general welfare, or be injurious to other property or improvements to a neighboring property. They questioned whether they had any say or consideration of the modification in any other capacity as they felt they should have a say and act as the initial screening.

Chairman Serafino commented on the fact that things change often even building materials costs etc. which would favor the argument that a modification of standards would be helpful since the Zoning Ordinance can't capture everything that may present 100% of the time and as it stands currently our Zoning Ordinance leaves zero flexibility.

Chairman Serafino suggested that since all of the Commissioners were on board with the need for Modification of Standards the real task for everyone was to provide feedback to Mr. Baumgartner as to what items they felt made the most sense and determine the non-negotiables.

Some of the Commissioners felt that a procedure was necessary if the Town was going to allow Modifications of Standards. Some of the Commissioners mentioned that they didn't feel it was necessary to make a list of what modification could be requested suggesting that it made more sense to allow applicants the ability to ask for a modification knowing that as Commissioners they had a right to say "no", however, they felt that a list of what couldn't be requested as a modification such as density should be noted. The Commissioners also felt that the procedure needed to be defined with regards to the options the Planning Commission had in terms of if they could approve a request amended to that of what was asked by the applicant or if it would be a straight yes or no forcing the applicant to then come back and ask for a revised request after hearing discussion by the Planning Commission as to what they might approve instead. They also wanted to make sure that it was clearly defined as to what fees would need to be paid, how to locate the fee for applicants and to determine if any opportunity would present for such fee to be waived. The Commissioners also asked that a firm understanding be laid out as to who could utilize the Modification of Standards.

Mr. Baumgartner also explained relative to Article 8 that process requirements in the form of checklists were removed from the Zoning Ordinance in his proposed revisions allowing the ability to make changes quickly instead of having to go through the full process taking months to make a change. He further explained that the checklists would still exist but be on the Town's website instead of within the Zoning Ordinance allowing any future changes to be approved by the Planning Commission directly instead of the 4-month process that currently stands. He also explained that the checklists wouldn't be published until the Planning Commission had reviewed each one and approved such. Mr. Baumgartner stated that he was revising some of the checklists and adding some, but that he would be sending all of them to the Planning Commissioners for their feedback and approval.

The last question that presented from the Commissioners in discussion was if Developers had a means to see where they were in any process as it would be helpful, in their opinion. Mr. Baumgartner stated that currently with the new online submittal portal the developers now have a means to see where they stand with their submittals. He proceeded to also say that he was revising the existing flowchart to put on our website to further assist Developers.
